Important news on tax sale foreclosures has come to light in the state of New Jersey. All real estate practitioners should be aware of this important decision from the U.S. Supreme Court. The New Jersey Courts are already adjusting in light of the issues of equity discussed in the case of Tyler v. Hennepin County. See attached.
The New Jersey Legislature has also introduced legislation to protect homeowner’s equity when facing a foreclosure due to unpaid municipal liens. A5302 and A5542 are also attached.
